Marriage contract

The marriage contract is a formal deed, in which a future husband and wife set out any terms of their marriage as they see fit, albeit within the confines of the legal rules. They may not deviate from the rules governing public order and common decency, from the rules setting out the respective rights and duties of the husband and wife, or the rules on managing communal estate and assets. If there is no marriage contract, then they are governed by the statutory prenuptial system. The husband and wife may change the points of the contract during their marriage.
The contact must be drawn up prior to marriage. To this end, the parties must appear before a notary. The contract takes effect on the date of the marriage ceremony. The marriage certificate must provide the following information: date of the contract, the name and address of the notary who drew up the contract, and the type of marriage contract.

Another important document for the person who is going to get married is a marriage license. People are not really married unless they obtain a marriage license. When you marry with a marriage license, you grant the State jurisdiction over your marriage. To get a license, a written application must be filed with the Clerk of the Superior Court in any county of the state or with some justices of the peace, city clerks or town clerks. Call the Clerk of the Superior Court in your state for information on where to apply for a marriage license. The official, who issues the marriage license, shall show on the face of it the exact time and date of issuance. The official shall also indicate on the marriage license whether the parties intend to enter into a covenant marriage.


Covenant marriage does not replace the kind of marriage already available. Instead it offers an additional option to couples who wish to marry. The covenant marriage differs both in the steps necessary to get married, and the reasons why a legal separation or divorce may be granted by the court. Covenant marriage is a commitment for life.


To enter into a covenant marriage, the couple first must have counseling (called "premarital counseling") from a member of the clergy or a marriage counselor. Then, when applying for a marriage license to be married, both must show their intention to enter into a covenant marriage by signing a special statement (or "declaration") on the application form. In a covenant marriage, legal separation or divorce may be granted by the court only for specific reasons, listed in state law.
