Divorces are a tough time for couples and an English divorce is no different. The divorce is even harder if the couple has a family also. In an English divorce there are 5 grounds for divorce. These are Adultery, Unreasonable behaviour, if you have been separated for two years or more and both of you agree a divorce, if you have been deserted for 2 years or if you have been separated for 5 years or more. Not many people understand what happens in an England divorce, this may put them off and think that it may be too complicated. When your partner receives the form they should then fill in a type of receipt to state whether they accept that the divorce should be granted. That receipt is then copied to you. Next you will have to obtain a document called a "request for directions for trial" and send it to the Court office. This may have to be supported by an affidavit, which is another form with states someone else stating that everything else in the documents are correct and true. The District judge will check all of the paperwork to establish that you have proved grounds for a divorce. If the judge declares that you have the proved grounds for divorce then you will be given a date for when the divorce will be partly announced. Then finally 6 weeks later providing that there are no problems the final part of the divorce papers will be sent to you, which will contain the decree absolute, which is the final legal end to the marriage. All this may seem overwhelming but if you get the right help such as a lawyer then you will have no problems with any of the forms. Your lawyer will be able to help you with all the work.
If you have children then the procedure may be held up a little. But your lawyer will talk you through any complications that may occur and will of course answer any questions that you may have about the procedure. If you and your partner are having a dispute about where the children or child should live (if you have any children) then the court has the power to make certain orders, which can affect the overall outcome of, were the child should live.
Plus they can also decide how frequently you or the other partner can see them. But of course these orders will only come into affect if you can't agree with your partner.
