When a couple know that their marriage is heading for divorce and they have tried everything to resolve it then they know that it is time to apply for a divorce. Divorces happen all the time and it doesn't signal a failure of a marriage it can be seen as a new beginning for many people. Because the couple have tried everything they can to try and get the problem sorted out between them ad it hasn't worked, so they have tried but have said that they can't do it anymore.
If you get the ball rolling with the divorce then you would expect your partner to do the same and keep going with you doing all the things that are necessary for a partner to do in a divorce. But sometimes this fails to happen and then the partner will start to change their mind about a divorce and you are left thinking well what can I do now. It is not a trap because you can go for an uncontested divorce.
An uncontested divorce occurs when you do not have any disagreements with your partner about finances or any divorce related issues such as child custody or partner support. You can also apply for an uncontested divorce when your partner agrees to the divorce or if your partner fails to appear in the divorce action. Of course that may cause some delay on the divorce but you will still be granted an uncontested divorce.
Some people have actually gone for an uncontested divorce thinking that the whole proceeding will be uncontested and just a simple divorce but then they have found out that the partner has decided to contest the case. When that occurs they have consulted their attorney for options that are available to them. Or they have decided to go on their own and fight the case.
A divorce petition can only be carried out if you have been married to your partner for more then a year. If you have been married for less then a year then you will have to apply for a different kind of divorce. Usually couples that have been married for under a year that seek a divorce are usually told to really think about it and they end up staying together. Also marriages that last under a year are frowned upon due to the fact that many marriages are then considered to be rushed marriages and the authorities can then be called to investigate such weddings.
When you receive the response from your divorce petition papers you have to look for the question that says do you intend to defend the case. If the answer is no you can now ask the court to consider if you have enough grounds for a divorce plus if the arrangements you propose for the children if you have any of course are satisfactory. This process is also know as applying for directions for trial and this means that you are very close now to getting that divorce that you have wanted for a while.
Divorce comes in many different forms and these are just a couple of ways to get a divorce there are also many grounds that you can use when applying for a divorce. The most common ground for divorce is unreasonable behaviour and it seems that many people are treating their partner unfairly and they still seem really surprised when they get the divorce papers through the door.
